Terms of Service

These Terms of Service ("Terms") govern your access to and use of StorySpark, an AI-powered personalized reading platform for children, operated by Random Synergy LLC ("we," "us," or "our"). By creating an account or using StorySpark, you agree to be bound by these Terms.

1. Eligibility and Accounts

1.1 Parent and Guardian Accounts

You must be at least 18 years of age to create a StorySpark account. By registering, you represent and warrant that you are a legal adult and, if creating child profiles, that you are the parent or legal guardian of those children and have the authority to consent to data collection on their behalf.

1.2 School and Teacher Accounts

School administrators may create institutional accounts and invite teachers. Schools using StorySpark represent that they have obtained any required parental consent or that they are acting as the agent of consent under COPPA. Teachers may only access student data within their assigned classrooms.

1.3 Child Access

Children access StorySpark through profiles created by their parent or teacher. Children authenticate with a 6-digit passcode set by the parent and do not create their own accounts. Parents are responsible for supervising their children's use of the platform and configuring appropriate parental controls.

1.4 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

2. The Service

2.1 Description

StorySpark generates personalized stories and illustrations for children using artificial intelligence. Content is tailored to each child's age, reading level, and interests. The platform includes reading progress tracking, gamification features (achievements, rewards, reading streaks), and analytics for parents and educators.

2.2 AI-Generated Content

Stories and illustrations are generated by artificial intelligence models. While we implement safety filters and age-appropriate content controls:

  • AI-generated content may occasionally contain inaccuracies, inconsistencies, or unexpected elements
  • We do not guarantee that all generated content will be perfectly suited to every child's sensitivities or preferences
  • Parents can enable prompt approval mode to review and approve story topics before content is generated
  • We continuously improve our content safety systems and encourage parents to report any concerns

2.3 Service Availability

We strive to provide uninterrupted access to StorySpark but do not guarantee that the service will be available at all times. We may perform maintenance, updates, or experience downtime. AI story generation depends on third-party API availability.

3. Subscriptions and Billing

3.1 Free and Paid Plans

StorySpark offers both free and paid subscription tiers. Free accounts may have limitations on the number of stories generated, child profiles, and available features. Paid subscription details, including pricing and included features, are displayed on the subscription management page.

3.2 Payment Processing

Payments are processed securely by Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis according to your chosen billing cycle. You agree to provide accurate and complete billing information.

3.3 Cancellation and Refunds

You may cancel your subscription at any time through the account settings. Upon cancellation, you retain access to paid features until the end of your current billing period. We do not provide prorated refunds for partial billing periods. Previously generated stories remain accessible on the free tier.

4. Acceptable Use

You agree not to:

  • Use StorySpark for any unlawful purpose or in violation of any applicable laws
  • Attempt to generate inappropriate, harmful, or explicit content through story prompts
  • Circumvent parental controls, content safety filters, or access restrictions
  • Share your account credentials or allow unauthorized access to child profiles
  • Use automated tools, bots, or scripts to access the service or generate bulk content
  • Reverse engineer, decompile, or attempt to extract the source code of the platform
  • Interfere with or disrupt the service, servers, or networks connected to StorySpark
  • Use the platform to collect personal information about other users

5. Intellectual Property

5.1 Platform Ownership

StorySpark, including its design, code, features, and branding, is the intellectual property of Random Synergy LLC. All rights not expressly granted are reserved.

5.2 Generated Content

Stories and illustrations generated for your family are provided for your personal, non-commercial use. You may save, print, and share stories generated for your children within your household. You may not resell, redistribute, or commercially exploit AI-generated content.

6. Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms, engage in abusive behavior, or misuse the platform. In such cases, we will provide notice and an opportunity to retrieve your data where feasible. You may delete your account at any time through the account settings, which will permanently remove all associated data as described in our Privacy Policy.

7. Disclaimer of Warranties

STORYSPARK IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT AI-GENERATED CONTENT WILL BE ERROR-FREE, ENTIRELY AGE-APPROPRIATE, OR MEET YOUR SPECIFIC EDUCATIONAL REQUIREMENTS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RANDOM SYNERGY LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, REVENUE, OR PROFITS, ARISING FROM YOUR USE OF OR INABILITY TO USE STORYSPARK. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify and hold harmless Random Synergy LLC from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of StorySpark, your violation of these Terms, or your violation of any third-party rights.

10. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of StorySpark shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.

11. Changes to These Terms

We may modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the platform at least 30 days before they take effect. Your continued use of StorySpark after changes become effective constitutes acceptance of the revised Terms. If you do not agree with the changes, you may cancel your account before they take effect.
